An off-duty LAPD Officer who allegedly broke a man’s jaw at a 2011 party in Whittier has been charged with battery with serious bodily injury and will be arraigned in January, the District Attorney’s Office announced today.

Donald Albert Peko, 35 (dob 1-22-77), appeared in court today for arraignment on the one felony count in case BA405213, but his arraignment was continued to Jan. 18, 2013, said Deputy District Attorney Geoffrey Rendon with the Justice System Integrity Division. Peko was released on $50,000 bail.

At a family party in Whittier on July 23, 2011, Peko allegedly told 23-year-old Christopher Price that he could not leave the party with an open container of alcohol. When Price started to drink to finish the bottle, Peko allegedly punched him once in the jaw without warning. Price suffered a broken jaw.

Peko was arrested Wednesday by Whittier Police Department officers, who conducted the investigation.

If convicted, Peko faces up to four years in state prison.
