VAN NUYS – A 33-year-old woman arrested over the weekend outside John Cusack’s home was charged today with stalking the actor.

Emily Diane Leatherman (dob 9-12-1974) was expected to appear for arraignment later today in Department 100, Van Nuys Superior Court. She has been in custody since her arrest in Malibu on Sunday by Sheriff’s deputies.

Leatherman was charged in case No. LA058579 with one felony count of stalking Cusack between Feb. 1, 2007, and March 30, 2008. She also was charged with two misdemeanor counts of disobeying a court restraining order and petty theft. The petty theft victim was not Cusack.

The defendant, who listed a Santa Monica address when arrested, is being held on $500,000 bail. If convicted of the stalking charge, she faces a possible maximum state prison term of three years. Each misdemeanor count carries a possible six-month jail term upon conviction.

Deputy District Attorney Ann W. Ambrose of the Target Crimes Division filed the case.
