August 16, 2022: Third Person Charged With Murder of Off-Duty Monterey Park Police Officer Gardiel Solorio

Los Angeles County District Attorney George Gascón announced today that his office has filed murder charges against Gerardo Magallanes for his alleged role in the murder of off-duty Monterey Park Police Officer Gardiel Solorio last week.

“We will ensure that anyone involved in the tragic and senseless killing of officer Solorio is held accountable,” District Attorney Gascón said. “My office commends the excellent investigative work of the police in this case and tracking all who were involved.”

Magallanes (dob 3/6/04) is charged in case VA158939 with one count of murder, shooting at an occupied vehicle and unlawful possession of a firearm while on probation.

His arraignment yesterday was continued to Sept. 8 in Department J of the Los Angeles County Superior Court, Norwalk Branch. 

Last week, Carlos Daniel Delcid was arrested and is charged in the same case with one count of murder, shooting at an occupied vehicle, possession of a firearm by a felon, and with the special circumstance allegation that the murder was committed during a carjacking.  

He is scheduled for arraignment on Sept. 8 in Department J.

A minor also was charged last week in Juvenile Court with the murder of Officer Solorio. 

On August 8, the minor allegedly drove Delcid and Magallanes to a gym parking lot where Officer Solorio was parked. Delcid is charged with getting out and then approaching Solorio with a firearm in an attempt to rob him and take his car.

While the minor and Magallanes waited nearby, Delcid allegedly shot the victim multiple times as Solorio backed out of the space, then returned to the waiting car and fled with the minor and Magallanes.

The case remains under investigation by the Downey Police Department.
