A Montebello police officer has been charged with unlawfully assaulting a suspect while arresting the man for tagging, the Los Angeles County District Attorney’s Office announced today.

Cpl. Mark Jason Ryan (dob 11/19/78) surrendered to Sheriff’s deputies this morning on a felony complaint for arrest warrant and was later released after posting $35,000 bond, said Deputy District Attorney Amy Pellman Pentz with the Justice System Integrity Division, who is prosecuting the case.

While responding to a call on Oct. 31, 2014, that two men were tagging in the 2100 block of West Whittier Boulevard, Ryan allegedly slammed one suspect’s head into the pavement.

He is charged in case BA445483 with one count of felony assault under color of authority. He is scheduled to be arraigned at 8:30 a.m. on May 4 in Department 30 at the Foltz Criminal Justice Center.

If convicted, he faces up to three years in state prison.

The Los Angeles County Sheriff’s Department investigated the case.
