July 26, 2016: Felon Charged with Capital Murder, Attempted Murder in Pomona

A 23-year-old man was charged today with shooting a driver and fatally injuring the victim’s passenger in a car-to-car shooting in Pomona, the Los Angeles County District Attorney’s Office announced.

Robert Bogan (dob 12/12/92) of Pomona has been charged with one count each of murder and attempted murder in case KA113087.

The felony complaint includes a special circumstance allegation that the murder was intentional and perpetrated by means of discharging a firearm from a vehicle, intentionally at another person and persons outside the vehicle with the intent to inflict death.

Additionally, the charging document alleges that Bogan personally and intentionally discharged a handgun, which caused great bodily injury and death.

The felony complaint alleges that Bogan was previously convicted of preventing/dissuading a witness/victim by force or threat and possession for sale of cocaine base in 2012.

The defendant was scheduled to be arraigned today, but the court appearance was continued to Aug. 28 in Department N of the Los Angeles County Superior Court, Pomona Branch. Bogan is currently being held on no bail.

Prosecutors said in the early morning of July 23 a man and a woman were driving near San Antonio and Holt Avenues in Pomona when Bogan allegedly drove alongside them and shot numerous times into their car before fleeing the scene.

Officers patrolling the area heard the gunshots and located both the victims’ vehicle and the defendant’s car, prosecutors said.

Officials responded to the female victim, Debbie Gutierrez, and she was taken to the hospital for medical treatment. Gutierrez, 34, later died from her wounds. The male victim suffered non-life threatening injuries, prosecutors added.

Less than an hour after the shooting, Bogan was arrested in connection with the fatal attack.

Prosecutors will determine at a later time whether to seek the death penalty or life in state prison without the possibility of parole.

The case is being investigated by the Pomona Police Department.
